Overview

Welcome to Snackstalgia. The terms "we", "us" and "our" refer to Snackstalgia, which operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Snackstalgia is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully. They contain important information about your legal rights, including disclaimers of warranty and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access the Services.

1. Access and account

You must be at least 18 years old, or the age of majority in your place of residence, to place an order.

To use the Services you may be asked to provide certain information, including your name, email address, delivery address and a contactable mobile number. You confirm that the information you give us is accurate, current and complete, and that you are entitled to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our products

We sell curated boxes of packaged food products. Each box is built around a single country, and the products in it are manufactured in that country. We acquire those products from suppliers within the United Arab Emirates.

The contents of each box are selected by us. Photographs and descriptions on the website are illustrative. Product appearance, packaging and specific contents may differ from what is shown, and manufacturers may change packaging or recipes without notice.

We may change product descriptions, discontinue any product, or limit the quantity available to any person or area, at any time and without notice.

3. Orders

When you place an order you are making an offer to buy. We are not obliged to accept it. Your order is accepted when we confirm acceptance to you; until then no contract exists between us.

We may decline or cancel an order for any reason, including where a product is unavailable, where the delivery address falls outside the area we serve, or where there is a history of refused or undeliverable orders. If we decline, change or cancel an order, we will try to contact you using the details you gave us.

Please check your order before submitting it. We may be unable to accommodate changes once an order has been dispatched.

Returns, refunds and cancellations are governed solely by our Refund policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale.

4. Prices and payment

All prices are shown in United Arab Emirates Dirhams (AED).

The price shown at checkout is the total amount payable. Delivery is included and no further charges, taxes or fees are added.

The price that applies is the price displayed at the time you place your order. Prices and promotions may change at any time without notice. Where a promotion has its own terms and those terms conflict with these Terms, the promotion terms apply.

Payment is collected on delivery. We do not take payment online at the time of ordering. You may pay by cash, card, bank transfer, Apple Pay or Google Pay when your box arrives, or you may ask us to send a payment link in advance.

5. Delivery

Delivery is governed by our Shipping policy.

All delivery times are estimates and are not guaranteed. We are not liable for delays caused by weather, road conditions, public holidays or other circumstances outside our control.

Risk in the products passes to you on delivery. Where you have paid in advance and asked us to leave your box with a third party or at a nominated location, risk passes once we have followed your instructions.

6. Food products, allergens and consumption

Please read this section before ordering.

6.1 Origin and labelling. The products we sell are manufactured overseas and acquired by us within the United Arab Emirates. Packaging and labelling may be in a language other than English or Arabic, and may carry additional importer labelling applied locally.

6.2 Ingredient and allergen information. Where we publish ingredient or allergen information, we do so in good faith as a convenience, compiled and where necessary translated from the manufacturer's packaging. We do not warrant that this information is accurate, complete or current. Manufacturers may change recipes, ingredients or packaging at any time without notice to us.

The packaging supplied with the product is the definitive source of information about that product. You should read it before consuming anything.

6.3 Allergens. Our boxes may contain, or be manufactured in facilities that also handle, nuts, peanuts, milk, eggs, soya, wheat and other cereals containing gluten, sesame, fish, crustaceans and molluscs. We are not able to guarantee that any product is free from any given allergen. Our products are not suitable for anyone with a severe allergy or intolerance. If you have any allergy, you consume our products at your own discretion and risk.

6.4 Dietary and religious requirements. We do not knowingly include pork, alcohol, or ingredients derived from either. In doing so we rely on the ingredient information declared on each product's packaging; we do not independently test or verify it. We make no representation that any product is halal certified, and we do not verify certification, unless a certification mark appears on that product's own packaging. Some products contain shellfish, molluscs or ingredients derived from them, on which dietary rulings differ. Where a product's suitability matters to you, please read the packaging and follow your own guidance before consuming it.

6.5 Consumption caution. Some products, including jelly confectionery, rice cakes and items presented on sticks, may present a choking hazard. Children and elderly persons should be supervised while eating them. Some products contain a source of phenylalanine and are unsuitable for people with phenylketonuria. Individual packaging carries the relevant warnings.

6.6 No health claims. Our products are food intended for general consumption and are not supplied for any medical, dietary, therapeutic or nutritional purpose. Nothing on the Services is intended as dietary or medical advice. You are responsible for deciding whether a product is suitable for you and for anyone you serve it to.

6.7 Nothing in this section limits or excludes any liability that cannot lawfully be limited or excluded.

7. Intellectual property

The Services, including all trade marks, text, images, graphics, video, audio and their selection and arrangement, are owned by Snackstalgia or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.

"Snackstalgia", our logo, and our product names and designs are our trade marks. You may not use them without our prior written permission. Shopify's name, logo and marks are trade marks of Shopify. All other marks appearing on the Services belong to their respective owners.

8. Third-party links and tools

The Services may link to, or provide access to, websites, materials and tools operated by third parties. We do not monitor or control them and we provide access to them "as is", without warranty or endorsement.

If you leave the Services to access third-party content, you do so at your own risk. We are not liable for any loss arising from your use of third-party websites, products or services. Complaints about a third party should be directed to that third party.

9. Relationship with Shopify

Snackstalgia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Snackstalgia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Snackstalgia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Snackstalgia.

10. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Services, and some of that information may be transferred to and stored in countries other than the one you live in. Certain personal information may additionally be subject to Shopify's own privacy policy.

11. Feedback and reviews

If you send us ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercially.

You confirm that you own or have the rights to any Feedback you send, that it does not infringe anyone's rights, and that it is not unlawful, abusive, obscene or misleading. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it. We may edit or remove Feedback at our discretion.

12. Errors and omissions

The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers and availability. We may correct any error and may change, update or cancel an order if any information relating to it was inaccurate, including after you have submitted it.

13. Prohibited uses

You may use the Services for lawful purposes only. You may not use them: for any unlawful or malicious purpose; to breach any applicable law or regulation; to infringe our rights or those of others; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send unsolicited advertising or spam; to impersonate any person or entity; or in any way that restricts anyone else's use of the Services.

You also agree not to: upload malicious code; reproduce, duplicate, copy, extract, sell or resell any part of the Services; collect or track the personal information of others; or use any robot, spider, scraper, data-extraction tool, automated agent or similar means to access the Services or to circumvent any security or access-control measure.

We may suspend, disable or terminate your access at any time, without notice, if we determine you have breached these Terms.

14. Termination

We may terminate this agreement, or your access to the Services or any part of them, at our discretion and without notice. You remain liable for any amounts owed up to the date of termination.

Sections 6, 7, 11, 14, 15, 16, 17, 22 and any other provision that by its nature should survive termination will continue to apply.

15. Disclaimer of warranties

Information presented on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.

Except as expressly stated by us, the Services and all products offered through them are provided "as is" and "as available", without representation, warranty or condition of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, durability, title or non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

16. Limitation of liability

To the fullest extent permitted by law, Snackstalgia, its owners, employees, agents, contractors, service providers and licensors, and those of Shopify, will not be liable for any indirect, incidental, punitive, special or consequential loss or damage of any kind, including loss of profit, revenue, savings or data, arising from your use of the Services or of any product bought through them, whether in contract, tort, strict liability or otherwise, even if we were advised of the possibility.

Where liability cannot lawfully be excluded, our total liability to you for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

17. Indemnification

You agree to indemnify and hold harmless Snackstalgia, Shopify, and our respective owners, employees, agents, contractors and service providers, from any loss, damage, liability or claim, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or third-party right, or your use of the Services.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted and severed to the extent it cannot be. The remaining provisions continue in full force.

19. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision.

These Terms, together with any policies we post on the Services, constitute the entire agreement between you and us and supersede any earlier agreements or communications between us, including earlier versions of these Terms.

20. Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign them without notice to you.

21. Headings

Headings are for convenience only and do not affect the interpretation of these Terms.

22. Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them or with any purchase made through the Services, are governed by the laws of the United Arab Emirates. You and Snackstalgia submit to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

23. Changes to these Terms

You can review the current version of these Terms on this page at any time. We may update, change or replace any part of them by posting the revised version here. It is your responsibility to check periodically. Your continued use of the Services after a change takes effect constitutes acceptance of it.
